Opposition Group Wins Procedural Victory Against Gibson
The Trademark Trial and Appeal Board has emphatically denied Gibson Brand, Inc.’s Motion to Dismiss the opposition proceeding seeking to stop Gibson’s attempt to obtain a trademark registration for a generic outline of a semi-hollow body electric guitar brought by 15 guitar companies. The Board held that Gibson’s “motion is not well taken” and held that the 15 opposers had clearly met all legal standards required in its pleading.
